Introduction
These terms and conditions apply to driving lessons and related services provided by Saqib Driving School.
By booking a lesson, making a payment or using our services, you confirm that you have read and accepted these terms. If the learner is under 18, a parent or legal guardian may make the booking and accept these terms on the learner’s behalf.
Lesson Bookings
- Lessons are subject to instructor availability.
- Lesson dates, times, duration and collection locations must be agreed with your instructor.
- You are responsible for providing accurate contact, collection and driving-experience information.
- We may decline or postpone a booking when an instructor is unavailable or it would not be safe or appropriate to provide the lesson.
- Regular lesson times are not guaranteed unless they have been confirmed by your instructor.
Lesson Fees and Payment
- Lesson fees must be paid in advance or no later than the beginning of the lesson, as agreed with your instructor.
- Block-booking packages must normally be paid in full before the first lesson included in the package.
- Any promotional or block-booking discount applies only under the conditions stated when the booking is made.
- Current prices will be confirmed before payment.
- We may change our prices, but a change will not affect lessons that have already been paid for and confirmed.
- Driving-test fees charged by the DVSA are separate from lesson and test-day vehicle fees.
Cancellations and Rescheduling
- You must provide at least 48 hours’ notice if you want to cancel or reschedule a lesson.
- Notice should be given directly to your instructor by telephone, text message or WhatsApp.
- If less than 48 hours’ notice is provided, you may be charged up to the full lesson fee where the reserved time cannot reasonably be offered to another learner.
- Failure to attend a confirmed lesson without notice may result in the full lesson fee being charged.
- If exceptional circumstances prevent you from attending, please contact your instructor as soon as possible. Any waiver or reduction of the cancellation charge will be considered reasonably on an individual basis.
- If your instructor cancels a lesson, the lesson will be rearranged or any amount paid for that lesson will be credited or refunded.
- Saqib Driving School is not responsible for reasonable delays or cancellations caused by circumstances outside our control, including severe weather, dangerous road conditions, illness, vehicle breakdown or road closures. We will make reasonable efforts to rearrange the affected lesson.
Late Arrival
- You should be ready at the agreed collection point when the lesson is scheduled to begin.
- If you arrive late, the lesson will normally still finish at the original scheduled time.
- If your instructor arrives late, the missing time will be added to the lesson, carried forward or rearranged.
- If you cannot be contacted or are not present at the agreed collection point, the instructor may leave after a reasonable waiting period and treat the booking as a missed lesson.
Driving-Licence Requirements
Before taking lessons on public roads, you must:
- Hold a valid UK provisional or full driving licence appropriate for the vehicle
- Meet the legal minimum age and eyesight requirements
- Be legally entitled and medically fit to drive
- Provide your driving-licence details when reasonably requested
- Inform your instructor of any licence restrictions, endorsements, disqualifications or pending legal matters that may affect your ability to drive
Your instructor may ask to check your driving-licence entitlement before your first lesson and at reasonable intervals afterwards.
A lesson may be cancelled if you cannot demonstrate that you are legally entitled to drive. Any cancellation charge will depend on the circumstances and the amount of notice provided.
Medical Conditions and Medication
You must inform your instructor about any medical condition, disability, eyesight issue or medication that could affect your ability to drive safely.
You are responsible for notifying the DVLA of any relevant medical condition when legally required. You must not attend a lesson while affected by medication, illness or any condition that makes driving unsafe.
Alcohol and Drugs
You must not attend a lesson while under the influence of alcohol, illegal drugs or any medication that impairs your ability to drive.
If your instructor reasonably believes that you are unfit to drive, the lesson may be cancelled immediately in the interests of safety. The lesson fee may not be refunded where the cancellation results from your failure to comply with this requirement.
Conduct and Safety
During a lesson, you must:
- Follow reasonable safety instructions from your instructor
- Treat your instructor, other road users and members of the public respectfully
- Avoid using a handheld mobile telephone or other distracting device
- Inform the instructor if you feel unwell, overwhelmed or unable to continue safely
A lesson may be stopped if you behave dangerously, abusively or unlawfully, or repeatedly refuse to follow safety instructions.
Where a lesson is ended because of serious misconduct or an immediate safety risk created by the learner, the lesson fee may not be refunded.
Driving-Test Bookings
- Learners are responsible for booking, changing and cancelling their own practical car-driving tests through the official GOV.UK service.
- You should discuss possible test dates with your instructor before booking if you want to use the instructor’s vehicle.
- Booking a test does not automatically guarantee that an instructor or tuition vehicle will be available.
- You must provide your instructor with the correct test date, time and location as soon as the booking is confirmed.
- Saqib Driving School cannot guarantee that any learner will pass their theory or practical driving test.
Use of the Instructor’s Vehicle for a Driving Test
Use of an instructor’s vehicle for a practical test is subject to:
- The learner having reached a safe and suitable test standard
- The instructor’s professional assessment
- The instructor and vehicle being available
- All applicable lesson and test-day fees being paid
- The test booking details being provided within a reasonable time
The instructor may refuse or withdraw use of the vehicle if they reasonably believe:
- The learner is not ready to drive safely without assistance
- The learner’s driving presents a risk to the public, examiner, vehicle or learner
- The test information is incorrect or has changed without sufficient notice
- The learner does not meet the legal, medical or licence requirements
- The vehicle cannot legally or safely be used for the test
- Relevant fees remain unpaid
Where reasonably possible, the instructor will explain the decision and provide appropriate notice.
DVSA Test Changes and Cancellations
Saqib Driving School is not responsible for:
- Tests cancelled, postponed or moved by the DVSA
- Decisions made by a driving examiner
- Test-centre closures
- A learner arriving late or without the documents required by the DVSA
- Additional costs caused by a DVSA cancellation or change outside our control
If a test is cancelled, any lesson or vehicle fee will be considered according to the time reserved, services already provided and whether the instructor can reasonably use the reserved time for another booking.
Block Bookings
- Block-booking credit belongs to the learner named when the package is purchased and may not be transferred without prior agreement.
- Unless otherwise agreed, block-booked lessons should be used within six months of purchase.
- If illness, instructor availability or another reasonable circumstance prevents the lessons from being completed within that period, an appropriate extension may be considered.
- Packages do not guarantee a particular instructor, vehicle or recurring lesson time unless expressly agreed.
Refunds
If you request a refund for unused prepaid lessons, the refundable amount will be calculated after deducting:
- The price of lessons already provided
- Any valid late-cancellation or missed-lesson charges
- Any other reasonable amount that we are legally entitled to retain
Any refund will be made using an agreed payment method within a reasonable period.
Nothing in these terms limits your statutory rights, including any rights you may have where services have not been provided with reasonable care and skill.
Instructor and Vehicle Changes
We may occasionally need to change an instructor or tuition vehicle because of availability, maintenance, illness or another operational reason.
Where this happens, we will make reasonable efforts to provide suitable alternative arrangements and minimise disruption to your lessons.
Personal Property
You are responsible for personal belongings brought into the tuition vehicle. Saqib Driving School is not responsible for property that is lost, damaged or left in the vehicle unless this results from our negligence.
Liability
Saqib Driving School will provide tuition with reasonable care and skill.
We are not responsible for losses caused by:
- DVSA decisions or test results
- Traffic delays, road closures or severe weather
- Events outside our reasonable control
- Inaccurate information provided by the learner
- The learner’s failure to follow legal or safety requirements
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Privacy
Personal information is handled in accordance with the Saqib Driving School Privacy Policy.
Information may be shared with the instructor assigned to your lessons and other service providers where reasonably necessary to manage your booking and provide the requested services.
Complaints
If you are unhappy with a lesson or service, please contact us as soon as possible and provide:
- Your name and contact details
- The date of the lesson or booking
- The instructor’s name, if known
- A clear description of your concern
- The outcome you would like us to consider
We will review the matter and aim to respond within a reasonable period.
Changes to These Terms
We may update these terms when our services, prices, business practices or legal responsibilities change.
Updated terms will apply to future bookings. Changes will not remove rights relating to lessons or packages already purchased unless required by law or agreed with you.
Governing Law
These terms are governed by the laws of England and Wales. Any dispute will be subject to the jurisdiction of the courts of England and Wales, without affecting any mandatory consumer rights that apply to you.
